7-Eleven Is Suing Nike Over Its Upcoming Air Max 95 Release

7-Eleven has filed a trademark lawsuit against Nike, accusing the sportswear company of copying its iconic orange, green and red stripe branding on an upcoming Air Max 95 sneaker.

The lawsuit, filed in federal court in Dallas, Texas, alleges that Nike’s new Air Max 95 features a “confusingly similar imitation” of the convenience retailer’s signature tri-color design. According to 7-Eleven, consumers could mistakenly believe the sneaker is affiliated with or endorsed by the brand.

The dispute has intensified because Nike reportedly plans to release the shoe on July 11, a date closely associated with 7-Eleven’s annual “7-Eleven Day” celebration and its popular Free Slurpee Day promotion.

In the filing, 7-Eleven claims it has used the orange, green and red color combination for decades across store signage, advertising, merchandise and branded products, and holds multiple trademark registrations related to the design.

The retailer also alleges that Nike intentionally designed the sneaker to evoke the 7-Eleven brand and benefit from its recognition. The lawsuit references media reports that have described the shoe as being inspired by 7-Eleven.

According to the complaint, 7-Eleven attempted to resolve the dispute before taking legal action, but alleges Nike intended to continue promoting the sneaker and proceed with its planned launch.

The company is seeking a court order preventing Nike from selling the Air Max 95, as well as a recall of any products already distributed. It is also requesting monetary damages and any profits generated from the sneaker’s sales.

Nike had not publicly responded to the allegations at the time of filing.
